An Indiana State Police officer from Rochester recently was arrested for allegedly driving while intoxicated.
John B. Weaver, 52, Rochester, is charged with operating a vehicle while intoxicated, a class A misdemeanor.
He was booked into the Kosciusko County Jail at 6:57 p.m. Aug. 6 on a $700 preliminary bond. He has been released on bond.
According to the probable cause affidavit, at approximately 6:35 p.m. Aug. 6, a Kosciusko County Sheriff’s Office deputy was dispatched to a fraternal organization about a suspicious person. The man, later identified at Weaver, had a firearm on his hip and attempted to open the door of the organization, which was locked. The deputy was told Weaver appeared to be intoxicated and was staggering around.
When the deputy arrived at the scene, the deputy saw a vehicle with Weaver in the driver seat and the vehicle started to back out of the parking spot it was in. The deputy pulled into the parking lot and turned around to get behind Weaver’s vehicle. When Weaver exited the parking lot, he turned right and was driving east on Lake Street. After Weaver’s vehicle made the turn, the deputy saw the front driver side and rear driver side tires cross over the solid center line. The vehicle then turned into a gas station.
The deputy approached the vehicle and Weaver exited the vehicle. According to court documents, Weaver used the vehicle to balance while standing. The deputy asked Weaver where he was coming from. Weaver said he was coming from a pizza restaurant for a football referee meeting. The deputy said he could smell alcohol coming from Weaver’s breath. Weaver also had bloodshot, watery eyes and slurred speech.
A KCSO corporal asked Weaver to step to the back of the vehicle. When Weaver did that, he walked with his hip against his vehicle. The corporal asked Weaver if he had been drinking and Weaver said he had about four drinks.
Weaver agreed to perform some field sobriety tests. Weaver failed several field sobriety tests. A portable breath test resulted in a 0.19 BrAC and a chemical breath test’s results were 0.219g/210L.
